Capital Law advises on landmark legal litigation funding venture

Capital Law advised New North Litigation Capital (NNLC) on the establishment of a £50 million funding line provided by alternative asset manager Pollen Street Capital (PSC).

NNLC has been launched to address a significant gap in the UK mid-market litigation funding space. It offers a unique proposition as the only UK litigation funder fully owned and operated by practising solicitors. The combination of PSC’s investment expertise with NNLC’s litigation experience, led by Christopher Nott, Andrew Brown and Guto Llewelyn, will enable NNLC to offer clients highly competitive funding rates alongside the strategic insight of practising solicitors.

Capital’s Debt Finance team advised NNLC on both facility and security documentation, including navigating facility documentation that was bespoke and heavily negotiated.

Capital’s team was led by Partners, James Butters and Chris Lewis, alongside Senior Associate, Anukrit Bhargava, with support from Associate, Michael Bolous, Solicitor, Emma Harding and Paralegal, Emily Herrod.

PSC was advised by Norton Rose Fulbright (NRF), with the expert team led by Partner, Christopher Akinrele and Senior Associate, Alex Smith.

This transaction is a significant achievement and reflects the continued growth in expertise of Capital’s Debt Finance team. Partners, James Butters and Chris Lewis, commented:

It was a pleasure working with PSC and NRF. Both the Capital and NRF teams enjoyed the challenge of accurately representing the commercially agreed terms of this complex and novel funding transaction. The coordination and collective determination of the NNLC and PSC teams were instrumental in bringing this project to fruition and achieving completion within a short timeframe, particularly for a transaction of this complexity.
