Financial Services Regulation
Clear, commercially focused financial services regulatory advice.
Financial services businesses operate in a highly regulated environment where decisions are subject to ongoing scrutiny from regulators, counterparties and stakeholders. Regulatory requirements intersect with commercial strategy, product design and market activity, requiring clear, practical judgement to manage risk while supporting growth.
As financial services regulatory lawyers, we provide commercially grounded legal advice to businesses operating across the sector. Our work covers how regulation applies in practice, from authorisation and perimeter analysis through to ongoing compliance, financial promotions and engagement with regulators. We ensure regulatory considerations are aligned with commercial objectives and operational realities.
Our financial services regulatory legal advice is grounded in how financial services businesses operate day to day. We work across a broad range of products and services, including insurance, regulated consumer credit, mortgages, savings products, investments, cryptoassets and payments. This reflects the range of structures and offerings we support, ensuring that regulatory advice is commercially relevant and capable of withstanding scrutiny.
We work closely with leadership teams and advisers across financial services businesses, including lenders, intermediaries and product providers, supporting organisations at different stages of growth from product development and launch through to expansion, restructuring and dispute scenarios.
Our focus is simple: helping financial services businesses navigate regulatory requirements with confidence, manage risk effectively and operate with clarity in a complex and evolving environment.

Expectations around new Consumer Duty reforms
The Consumer Duty came into force on 31st July 2023 and is centred around the new principle, which is Principle 12. A new Duty for ‘firms to deliver good outcomes for retail customers’.
It’s an important milestone for the FCA – for their business and statutory plan. The Principle is made up of three cross-cutting rules and these are the anchor to the Principle. Firms have to apply those three cross-cutting rules to four different outcomes.
Sarah Drew & Rachel Hillier consider the newly implemented Consumer Duty and what they think you can expect to see from the FCA over the next 12-24 months. They cover the background to Consumer Duty and some expectations for firms now that it is in force.
Hear from Liza Kellett, Trust Leeds
Following a lengthy application process, our Financial Services Regulation team were able to help Trust Leeds submit their application to the FCA, so they could provide consumer credit lending to those that wouldn’t be able to access it from high street banks.
The successful approval of their application by the FCA has allowed Trust Leeds to provide small, ethical, personal loans for business purposes to enterprising people in West Yorkshire who are facing money or credit problems.
Having gone through the process side by side with Liza, the team at Capital Law are here to help if you and your business are thinking about providing lending services and need support in obtaining approval from the FCA.
