Danielle O’Brien

Danielle is an Associate in our Construction team, with a focus on non-contentious construction and energy projects.

Danielle advises on JCT and NEC Contracts as well as other bespoke forms of contract. She works with local authority clients, universities, funders and developers, assisting them with the preparation of full suites of construction documents and development agreements for projects. She also advises private sector clients, contractors and sub-contractors. For several years Danielle has worked closely with some of our lender clients (the Development Bank Wales and Julian Hodge Bank Limited), running the construction due diligence element of their development finance projects.

Danielle has particular experience in the energy sector, having previously worked in-house at Welsh Power Group Limited, an independent developer and asset management business (with 550MW of flexible generation to provide grid stability services). Here, she reviewed operation and maintenance contracts and NEC sub-contracts, negotiated easements with electricity and gas distribution network operators (DNOs and GDNs) and assisted with corporate due diligence and desktop surveys for new development sites.

Danielle has recently been heavily involved in two projects run by the South Wales Industrial Cluster (SWIC), which focused on how to decarbonise heavy industry in South Wales. She was engaged in the formation of the Cluster, negotiating the collaboration agreement between all the parties, and has been key to its success. She also took an active role in the project’s Future Leaders Group and subsequently contributed to the setup of Net Zero Industry Wales (funded by Welsh Government).

Prepared a position statement for a local authority client to guide it through decision making on the merits (or not) of bringing an adjudication.

A private developer
Advised a private developer on the £8 million development of a residential care home including drafting the schedule of amendments to a JCT Design and Build 2016 Contract, negotiating deeds of appointment with the various consultants, reviewing sub-contracts and drafting collateral warranties.
